Sunnova's bankruptcy creates unique cancellation opportunities. In Chapter 11, contracts can be rejected by the bankruptcy trustee — if Sunnova's contracts are rejected, you may be released from your obligations and become an unsecured creditor for damages. File a proof of claim in the bankruptcy proceeding. Also pursue standard grounds: 3-day right, breach of contract for system underperformance, and state consumer protection claims. Consult a bankruptcy attorney alongside a consumer attorney.
Sunnova Bankruptcy Changes the Rules
When a company files Chapter 11 bankruptcy, its executory contracts — agreements where both parties still have ongoing obligations — can be assumed or rejected by the bankruptcy estate. If Sunnova's solar service agreements are rejected in bankruptcy, the homeowner is released from the contract and becomes an unsecured creditor for any damages. This is a materially different situation than a healthy company where the contract simply feels permanent.
You do not need to wait passively for this process. File a proof of claim in the Sunnova bankruptcy proceeding immediately. Document every complaint, every underperformance event, every warranty claim denied, and every month the system was not functioning. Your damages claim is filed there — and it protects your interests regardless of how the bankruptcy proceeds.
The 3-Day Right
If you signed any Sunnova agreement within the last 3 business days, cancel by certified mail immediately. This right exists independent of the bankruptcy.
Breach of Contract Before Bankruptcy
If your Sunnova system underperformed its contracted guarantee, went offline for extended periods, or caused unrepaired damage before the bankruptcy filing, you had breach of contract grounds that pre-date and survive the bankruptcy. These claims belong in your proof of claim filing.
Your Loan Continues — But Has Defenses
If you have a Sunnova loan or a loan from GoodLeap or another lender for a Sunnova system, payments continue to the lender. The FTC Holder Rule may give you defenses against the lender based on Sunnova's fraud or breach. Consult a consumer attorney immediately.
